These Terms and Conditions apply between you, the User of this Website, and Ms & Mrs Spa, the owner and provider of this Website. Ms & Mrs Spa is committed to providing a professional, safe, and transparent service to all our clients. These Terms and Conditions apply to our provision of all services, bookings, and facilities, as well as your use of this Website.

1. LEGAL BINDING AND SCOPE OF AGREEMENT

1.1. Formation of Contract: These Terms and Conditions (“Terms”) represent a legally binding agreement between MS Mrs Spa (“the Spa”, “we”, “us”, “our”) and the individual accessing our services (“the Client”, “you”, “your”). By booking an appointment, purchasing a gift voucher, or entering the Spa premises, you irrevocably agree to these Terms.

1.2. Precedence: These Terms supersede any previous oral or written agreements, representations, or understandings. In the event of a conflict between these Terms and any promotional material, these Terms shall prevail.

1.3. Amendments: We reserve the right to modify these Terms at our sole discretion. It is the Client’s responsibility to review the Terms prior to every booking. Continued use of our services constitutes acceptance of any updated Terms.


2. COMPREHENSIVE BOOKING AND RESERVATION PROTOCOLS

2.1. Booking Channels: Appointments may be requested via our website, telephonic communication, or in-person. A booking is not “Confirmed” until you receive a formal confirmation via email or SMS and the required security deposit has been processed.

2.2. Security Deposits: All bookings are subject to a mandatory security deposit.

  • Standard Treatments: 100% of the total service value.
  • High-Value/Aesthetic Treatments: 100% prepayment may be required at our discretion.
  • Refundability: Deposits are non-refundable but may be transferable if the Rescheduling Policy (Section 7) is followed.

2.3. Identity Verification: We reserve the right to request government-issued photo identification to prevent fraudulent bookings or for age-restricted treatments.

2.4. Waiting Lists: Inclusion on a waiting list does not guarantee an appointment. We will contact you in chronological order should a slot become available.


3. ARRIVAL, CHECK-IN, AND FACILITY ETIQUETTE

3.1. The “15-Minute Rule”: Clients are mandated to arrive 15 minutes prior to their scheduled start time. This period is dedicated to administrative compliance, environmental acclimatization, and consultation updates.

3.2. Late Arrival Consequences: * Under 15 Minutes Late: The treatment will proceed but will be truncated to ensure the session ends at the original scheduled time.

  • Over 15 Minutes Late: The appointment will be classified as a “No-Show.” The therapist reserves the right to refuse service to maintain the integrity of the day’s schedule.
  • Pricing: In all cases of lateness, the 100% original fee remains payable. No discounts are offered for shortened services due to client lateness.

3.3. Environmental Standards: To ensure a sanctuary environment:

  • Silence Policy: Mobile phones must be switched off or set to silent.
  • Atmosphere: Loud conversations or disruptive behavior will result in a request to leave the premises.
  • Children: For health and safety reasons, children under the age of 12 are not permitted in treatment areas unless they are receiving a pre-approved service.

4. MEDICAL COMPLIANCE AND THERAPEUTIC SAFETY

4.1. Mandatory Consultations: All new clients must undergo a physical or digital consultation. Returning clients must notify staff of any changes in health, medication, or lifestyle since their last visit.

4.2. Duty of Disclosure: You must disclose, without limitation:

  • Pregnancy: All stages of pregnancy and breastfeeding.
  • Medication: Use of blood thinners, Roaccutane, steroids, or photosensitizing medications.
  • Chronic Conditions: Cancer (past or present), Epilepsy, Diabetes, Heart Conditions, and Autoimmune disorders.
  • Recent Procedures: Surgical scars, botox, fillers, or chemical peels performed elsewhere within the last 30 days.

4.3. Patch Testing Mandate: Treatments involving dyes, chemical solutions, or high-intensity light (IPL/Laser) require a patch test at least 24–48 hours prior.

  • Waiver: We do not accept “signed waivers” in lieu of a patch test. Safety is non-negotiable.
  • Non-Compliance: Failure to attend a patch test will result in immediate cancellation of the main appointment and forfeiture of the deposit.

4.4. Contagious and Infectious Diseases: We strictly prohibit the treatment of clients with active cold sores, conjunctivitis, fungal infections, or flu-like symptoms. We reserve the right to reschedule any client who appears unwell.


5. TREATMENT SPECIFIC CLAUSES

5.1. Massage and Holistic Therapies: Our treatments are strictly professional and therapeutic. Any suggestive, inappropriate, or sexual remarks or actions will result in immediate termination of the treatment, a permanent ban, and reporting to the relevant authorities. The full fee will be charged.

5.2. Aesthetics and Advanced Skincare: Results for advanced skincare (microneedling, peels, etc.) are cumulative and vary by individual. No guarantee of specific results is provided.

5.3. Allergic Reactions: While we use hypoallergenic and professional-grade products, the Spa is not liable for allergic reactions that occur despite a successful patch test or due to undisclosed sensitivities.


6. AGE RESTRICTIONS AND VULNERABLE ADULTS

6.1. Under 16s: Must have a parent or legal guardian present in the treatment room at all times.

6.2. 16–18 Years: Require written parental consent on our standard consent forms.

6.3. Restricted Treatments: We reserve the right to set internal age limits for specific invasive or high-intensity treatments (e.g., advanced chemical peels) regardless of parental consent.


7. CANCELLATIONS, RESCHEDULING, AND NO-SHOWS

7.1. Individual Appointments: A minimum of 24 hours’ notice is required to cancel or reschedule.

7.2. Group/Package Bookings: A minimum of 72 hours’ notice is required for bookings involving 3 or more people or packages exceeding 3 hours in duration.

7.3. Fees for Breach:

  • Outside Notice Period: Deposit may be moved to a future date (valid for 3 months).
  • Inside Notice Period: The 100% deposit is forfeited.
  • No-Show (No Contact): You will be invoiced for 100% of the treatment value. Access to future bookings will be restricted until this debt is cleared.

8. GIFT VOUCHERS AND CREDIT TERMS

8.1. Validity: All vouchers are valid for 12 months from the date of purchase. We do not offer extensions unless required by extraordinary legal circumstances.

8.2. Non-Refundability: Vouchers are non-refundable and cannot be exchanged for cash or used to purchase other gift vouchers.

8.3. Redemption: The physical or digital voucher code must be presented at check-in. Without the code, an alternative payment method must be used.

8.4. Price Increases: If a voucher is for a specific treatment and the price of that treatment increases before redemption, the client must pay the difference.


10. LIMITATION OF LIABILITY

10.1. Personal Property: MS Mrs Spa provides storage for personal items but assumes zero liability for loss, theft, or damage to jewelry, electronics, or clothing. We recommend leaving valuables at home.

10.2. Medical Liability: The Spa is not liable for any injury or adverse reaction resulting from:

  • The Client’s failure to provide accurate medical history.
  • The Client’s failure to follow pre-treatment or aftercare instructions.
  • Natural variations in individual healing processes.

10.3. Aggregate Liability: To the maximum extent permitted by law, our total liability for any claim shall not exceed the price paid for the specific service that gave rise to the claim.


11. DATA PROTECTION AND PRIVACY (UK GDPR)

11.1. Data Collection: We collect “Special Category Data” (Health info) to ensure treatment safety.

11.2. Storage: Your data is stored on secure, password-protected servers compliant with UK GDPR.

11.3. Retention: Medical records are retained for 7 years to comply with insurance requirements, after which they are securely destroyed.

11.4. Marketing: You will only receive marketing communications if you have opted in. You may opt out at any time via the “Unsubscribe” link in our emails.


12. FORCE MAJEURE (UNFORSEEN EVENTS)

12.1. Definition: We are not liable for failure to perform our obligations due to events beyond our control, including but not limited to: Acts of God, pandemics, government-mandated lockdowns, power failures, water shortages, or strikes.

12.2. Remedy: In such events, we will attempt to reschedule your appointment. No monetary refunds will be issued for deposits in Force Majeure scenarios; instead, a Spa Credit will be provided.


13. COMPLAINTS AND DISPUTE RESOLUTION

13.1. Immediate Notification: Any dissatisfaction must be reported to the Spa Manager before leaving the premises or within 24 hours of the treatment.

13.2. Resolution Process: We reserve the right to inspect the “work” (e.g., lashes, nails, skin) and offer a corrective treatment free of charge. We do not offer cash refunds for services rendered.

13.3. Arbitration: If a dispute cannot be resolved internally, both parties agree to attempt mediation before initiating legal proceedings.


14. SEVERABILITY AND GOVERNING LAW

14.1. Severability: If any part of these Terms is found to be unenforceable by a court, the remainder of the Terms shall remain in full force and effect.

14.2. Governing Law: This contract is governed by the Laws of England and Wales. Any legal action shall be brought exclusively in the courts of England.


15. CLIENT ACKNOWLEDGMENT

By proceeding with your booking, you confirm:

You authorize MS Mrs Spa to process your data as outlined.

You are over 18 (or have parental consent).

You have read, understood, and agree to all 15 sections of these Terms and Conditions.
